E.F.Q y J.C.M, arrendatarios de una vivienda, habían sido acusados por parte de la Comunidad de Propietarios a la que pertenecía la misma de haber manipulado la instalación para beneficiarse del suministro común.
Aránguez Abogados, representado en este caso por la letrada María Martos, ha alegado diversos motivos por los cuales debían ser absueltos, entre ellos: prescripción del delito, falta de legitimidad activa y carencia de prueba que demostrase la defraudación (presupuesto esencial para la aplicación del tipo penal en concreto, el art. 255 del Código Penal).
Las partes acusadoras han decidido cesar en su postura, por lo que el Juez ha anticipado el dictado de una sentencia absolutoria.
